As far as your example, it's kind of hard to assess with so little info.  

That being said, generally fees incurred in pursuing legal action can not be assessed as additional rent, and must be explicitly provided for by a court order.

If you pay for testing then assess the risk, then you are in control.

Third party sites or tax assessed values are usually not really in line with actual market values.

I would agree with your assessment of the "hot" areas to the south, although I would caution you not to discount North Everett so easily.
