I am unable to understand what you are implying or how it in any way it could possibly help get a property out of an S Corp without causing a taxable event.

I'm not a realtor so I don't know your rules, but I wouldn't use the normal realtor contract, causes it says prop can't be assignment without written consent from seller, unless you have written consent. 

A) is there any concern moving a 1031 DST ownership into an irrevocable trust within 2 years?

In the maintenance agreement, they were responsible for paying for any future repairs not only to their physical water line, but also for any damages to our property, regardless of what/who caused the damage.

My concern would be if I tried to make it look like a match and it didn't, it may look bad.
