Ask your attorney to "ask" the carrier if the duty is on the adjuster to conclusively determine the loss took over 60 days ago and if the adjuster admitted he could not fulfill that duty, how was it not a basis to extend coverage rather than a denial.

Hi Nat,You need to check your original contract with your PM that spells out duties and official means of contact.The contract for example should say that e-mail, written, fax is official communication.If your contract didn't say e-mail was an acceptable form of notice to give PM the right to do something then the position is weaker.

May be this is the best way to reduce the time-- any bills, reconciliation, management fees, markups, etc would have to be accomplished as well.Can you check your employees duties and see where you can change some processed and procedures.Bookkeeping rates can vary from $15.00 to $125.00 an hour or you can find someone on a monthly basis.

Because they are not in the business of losing money and having loans default or getting stuck with risky loans on the books because no capital partners in the open market will take it.All these lenders out here sell their loans, Civic tried to hold and it took them under, so selling these loans off to investor groups looking for the ongoing payment stream for a fund they own is vital

In NC, our board of Realtor management agreement provides "Indemnify and hold Agent harmless to the extent allowable by law from any and all costs, expenses, attorneys’ fees, suits, liabilities, damages or claims for damages, including but not limited to, those arising out of any injury or death to any person or loss or damage to any property of any kind whatsoever and to whomsoever belonging, including Owner, in any way relating to the management of the Property by Agent or the performance or exercise of any duty, obligation or authority set forth herein or hereafter granted to Agent, or arising out of a tenant’s breach of any lease for the Property,except to the extent that such may be the result of gross negligence or willful or intentional misconduct by Agent"It sounds like there are claims of the PM being negligent and that may be a case for the owner to go after the PM.
