Laws vary state to state, in some states unless you have a specific agreement with the buyer, then you are working for the seller, but the way around that is to sign a buyers agency agreement with the agent.

For HW I would probably just not bother, use varies so much and people who don't pay, don't conserve(think 3 showers a day)  Heat you can put landlord thermostats in and insulate well but that doesn't stop them from opening windows in the dead of winter for some air..( really happened).
