In regards to bridging the gap, it's completely legal as long as everything is disclosed properly (note, it's been a while since I've had to do that, so the rules may have changed - verify with the lender).

The tax payer for the old property has to be the tax payer for the new property and any transfer right before sale that changes tax payers is looked at very suspiciously.

A couple things pop out to me.The first thing I would change is the equity.
