I've been told that due to "Force Majuere".Force majeure is a common clause in contracts which essentially frees both parties from liability or obligation when an extraordinary event or circumstance beyond the control of the parties, such as a war, strike, riot, crime, epidemic or sudden legal changes prevents one or both parties from fulfilling their obligations under the contract.

Hi Alecia, If it were my situation, I'd make an attempt to fulfill the obligation I committed to, and call #2.During the call, I'd try to get a feel for the individual regarding the excuses (childish and idiotic, or reality).Maybe Renter #2 is scheming Renter #1 somehow and does not want to be found out (Son of Sam or something).Or maybe Renter #2 is just the kind of person that does not follow through and then lies about it.Or maybe it's some kind of technical problem.Either way, if it were me, I'd be on a phone call with Renter #2 ASAP -- Because Time is money.

If you do go that route, you sue for "specific performance", meaning that the court can order the defendant to fulfill the terms of the contract.The question in this case goes to whether the contract was fully executed.
