In my experience, you can purchase the existing home and the encroachment is grandfathered in, meaning the vacant lot owner can't force you to move it.

While this hasn't been needed in the past, I’m considering if it could help prevent tenants from reporting problems later that they claim existed when they moved in.

@Sandee SampsonA construction attorney would be who to contact but you are going to spend a lot more than $7000 in getting this resolved against a builder.Also let’s say you win, the courts could also say you didn’t pay for a retaining wall which is needed so it’s a betterment to the property so you would still need to pay for the wall and they would be responsible for some soil etc.

You should be able to obtain them from the property owner, builder, or public records if they already exist.

If the subject floor is not perfectly flat, pour a self-leveler over the existing flooring (read the instructions on the bag FIRST).
