The only action controlled by the temp setting, is the length of the cooling cycle.

In that case, if they can provide us with proof of contract cancelation, we terminate their lease without a fee and refund their full deposit (assuming there isn't any property damage).

Is this something my realtor should have looked into; asked about the POS report and either found out the sellers weren't going to fix things or ask for proof they were compliant? 

If you find proof that a plumber flagged this as a bigger issue, you could have a case that the seller was aware but didn't disclose it.Best of luck!
