The two most important things(IMO) to focus on to prevent problems are:1)Disclosure - describing the property *accurately*, *fully* and *honestly*, warts and all.

Typically earnest deposit does not go hard until a few days after seller provides the necessary data and disclosures.  

The way you structure your company and how you're going to hold title will affect your ability to borrow and dictate which types of loan you can get, how much down payment you will be required to pay as well as rates, fees, disclosures and prepayment penalties etc...

Wholesaler never takes title and is only selling right to buy the property.Again, the lack of disclosure wholesalers go thru to hide stuff is problematic. 

Still legal to do, but there are specific forms and disclosures that must be used.
