Still wouldn't happen right away.Try to approach the situation diplomatically with him - you'll cooperate with showing the place, you'll leave it in perfect condition, but you cannot stay with that level of noise.Hopefully, he'll work with you and release you from your lease, and not keep your security deposit.

I thought FHA enacted a waiver in 2010 that got renewed in 2012 and extended through 2014 that waives the 90 flipping contingency for all situations except when the sales price is 20% or more of the sellers cost to purchase the property.

If that is what is giving them heartburn, they may be able to balloon it with a longer amortization (if it doesn't fall under the new Dodd Frank rules) or go variable to extend the term.
