Then his dad died, so they had to start over again, his mom, and my understanding is his mom had a stroke.Finally, I heard that bank is going to foreclose next month.Meanwhile, I have been urging the buyer, condo association president to take possession on behalf of the association and rent it out month to month cheap just to get some income, any income, and it looks like his lawyer said it is something they can do, but the bank may object.Any thoughts?

Understand rights of quiet enjoyment of possession, how and when you contact a tenant can quickly go to breach of their rights of quiet enjoyment, don't bug them, don't drop by with notices of mickey mouse inspection excuses to go inside, too much of that will cause problems.

From what I understand, Michigan is a Tax Deed auction state, which means that once the property goes to auction, the winner actually receives a deed and takes possession of the property.

There are Medicaid eligibility issues for the Mother, now living in a care facility, debt and probate issues for the Daughter's estate, a false quit claim executed by heirs that didn't inherit the property, and a host of family members living the house with alleged claims to the property.I can't quite wrap my head around buying this one sub-to the life estate AND the unprobated remaindeman estate without having full possession.

In the rent with option to buy contract should include the purchase price and terms, you should ask for 3% down nonrefundable for the option, the rent is that just rent unless you want to portion some of it towards reducing the purchase price, up to you. if they don't preform the option the 3% is yours and you now have possession of the property to do it all over again.
