If for any reason construction doesn't happen they will get a share in the land owned.Question 1): Is there any better way to structure this?

@Eric TanJust based on the limited info, I would structure a Lease with an Option.

If there is room for more than one structure on the subdivision, allow the builder to sell them off in pieces and pay you in increments.
