@Taylor Green As Ann was saying, you need an attorney, especially in collection issues if you're not familiar with applicable laws.While HMLs have fewer lending restrictions that one lending on an owner occupied home (they do the commercial side) it's not the wild west, they are regulated and every business transaction is covered under the Uniform Commercial Code (UCC).Lenders can only "attach" property that is taken for collateral, a HML is not going (or shouldn't be) toward securing cars, or boats or non-business assets as that constitutes a consumer loan and they'll likely be in violation of consumer lending regulations.

Licensing may then kick in and will doing any consumer lending, can if doing commercial lending.The finance industry is like 10, 55 gallon drums of water and RE financing is a gallon, finance is not real estate, real estate is just a sliver of the finance world, people here are entering no man's land thinking they can walk out on the streets and start lending money!
