@Lew Payne  48.23, paragraph (3) seems to state that the action must be based upon a recorded instrument, as in a mortgage I would think.  

I had never heard of such an instrument.

I guess the fundamental question here is: do the seasoning requirements apply based on the deed, regardless of how the deal was funded, or is it based on the instrument?
