If the tenant has a lease that expired a year ago, (ie: nobody can produce a current lease), then you just need to draw up a new lease, provide a month's notice of the increase, and if she won't sign or move out after the 30 days, consult a real estate lawyer or file for eviction.

If occupancy is hovering around 80%, but it's pre-leased at 90%, meaning there are people waiting for renovated units or the 1st of the month to move in, I would be less concerned (assuming they are signing leases at the projected rent levels).

So I inherited a squatter at closing.He was listed as “boyfriend” of previous tenant on lease I inherited from seller.Problem is that lease expired May 2018.The original tenant on the lease moved out on expiration of lease and i never met her.Now this boyfriend is late on rent.He’s technically not on lease.I’m planning to ask my agent to post a 3-day notice on Monday.But I’m not sure that even applies as technically he’s not my tenant as he never signed a lease.Has anyone dealt with this situation?
