When it exceeds a set level, or at a set date in the future (whichever comes first), the mortgage holder has to start paying the fully amortizing payment of the now much larger mortgage.

Now, even if it spelled out in the contract that the loan is secured by the property, I assume that it was formed as a 2nd which means, it doesn't change the 1st note holder position as a first in line.

When private lenders lend money they are always the first and only position lien holder on that piece of property so honestly I dont see how this small sum of money will help anyone.
