If the Houston property is currently being rented out, and the borrower does not otherwise maintain a US address, he would not be eligible.

It is also the case that reposition projects with heavy management and skill components should compensate the investors more than maintaining a stabilized asset.  

Negatives: Most still require effort to find the deal, market to find sellers, and potential work to rent the property or maintain it, can have complications with borrowers defaulting or renters needed to be evicted/trash the place.

I'd love to see updates on this thread over the next year or so - it's helpful to see how well these companies maintain their level of service over time.

As Brian and Doreen already mention, just putting it in a different way... make the decision only after you see the impact based on two aspects (1) the larger picture of your portfolio, income and taxes and (2) the impact to the IRA in terms of cashflow needs for the property.With regards to the DOL PTE 80-26 exemption, please use this as an extreme last resort as there are many a documentation that needs to maintained as justification for the DOL and the IRS (more than the requirements of any custodian).

The bldg. and apartments are in good condition, the previous owner had the property for 20+ years and maintained the bldg. very well but never increased any rents.
