All; The mortgage is only "extinguished" provided the clerk sent notice to the mortgage holder, if they were not given prior notice you'd better hope they are happy just going after the surplus and releasing the mortgage.

Hi @Casey CarrollWatch highly litigious states like NY, NJ, MA, DC, VA, MD, FL, CA, OH, etcLots of lawyers, better to get on title than lease option and assign or you will be charged with brokering agreements and acting as a fiduciary agent without a license.I use an option release, and I do not assign, just charge an option release fee.NC is good for licensed Brokers to do lease purchase.
