Now, if for some reason the tenant refused to move out, then at that point you may need to file an eviction (unlawful detainer) to remove them and recover possession of the property.

You can file a forcible detainer at the county for typically less than $110 in filing fees plus the cost of sheriff service which is between $50-85 depending on county abc the location within it.

As a CA landlord, (NorthernCalif. rural) I don't think of CA as "renter friendly", (and yes, I'm currently in the middle of an"eviction /unlawful detainer" process ) compared to much of the east coast; that is- unless you're in a CA "rent controlled" area, where the laws are VERY STRICT, and can vary wildly in each area, even inside city/county lines.

There's some more info on serving the notice here: http://www.dca.ca.gov/publications/landlordbook/terminations.shtml.If after serving the notice, the tenant doesn't pay in the allotted time, you're next step would be to file an Unlawful Detainer Lawsuit.

I don’t know Wisconsin Landlord Tenant Law.In Illinois, if a tenant doesn’t pay rent and 5 days has elapsed, lessor can file foricible entry detainer (eviction), even though you have already given them a 30 day notice.

The VRLTA has specific terms out lined for when there is no lease in place.  3) If/when they don't leave, file an Unlawful Detainer for holdover.

They only states that makes sense to do this, are states like California where they have ruined the rental business by stipulating to me crazy laws that make it unfair to the businesses and almost impossible to evict someone.Most states are 30 day notice, so files for a  unlawful detainer with a judgment, then in court tell the judge they are month to month.
