Key things to agree to The interest rateamortizing or interest only loanLength of loanLength of amortization (does not have to be the same as length of loan if there is a balloon payment)When are payments due; monthly, quarterly, annually at the end of the loan etc.Are there any upfront points to be paid and other misc terms like late fees.Then have an attoney create a Note and a Mortgage (or deed of trust depensing on the state)

The buyer continued to pay note for years to us but then sued us right before the balloon note was due, we could not foreclose while a lawsuit was pending.

NOW, if there was a recent storm that cause a sudden leak resulting interior damage you may not have much of a leg to stand on because HOA was not neglegent in doing timely repairs, it just happened.Now if you think they should repair but they won't you will have to sue your HOA (yourself also since you are an owner) Once they board and HOA recieve the letter from your attorney, they will likely just settle and fix your wall inside since it will be way more costly to defend and it may raise they HOA insurance next year, thus passing the cost to you via your HOA dues.
