Otherwise, proof-wise/court-wise, it's a he said she said and you're not going to get anywhere with that when the PM says they were never told by the tenant.

And the courts see someone who is licensed as having a vast advantage over the lay person, so if your written disclosures are not bullet proof, you and your broker may find yourself in court.   

If you have a savvy tenant and you keep the sd and they seek the advice of a lawyer, you could be looking at appearing in court and paying triple damages.  

The courts can see your option as a purchase agreement and the option price as a down payment and down payments may be returned. 

This would mean at the end of the year you have to declare your normal salary (your former job) like past years, but as Jean mentioned you now have to complete Schedule E (or your CPA) to report all rental income and expenses.

If you don't want to spend a ton of money - get on your city/town assessors site or go down to the town/city hall and courts and make your own list's - it takes time and you need to be free during the weekday's but there is always a way.
