You are required to close if the assignee doesn't.Saying attorneys are ignorant of the law is hubris in the extreme. 

Mike, My recommendation would be during due diligence for a potential purchase, ask for past 12 months of all utility bills, property taxes, and any other municipal requirements like rental permits, occupancy inspections etc. 

Next, as stated above, a DSCR loan cannot be in 2nd lien position.

Are you trying to raise the rent?

Interest paid on their loan or a percentage of the profit?

Wet signing the lease in person is the only opportunity to talk to the tenant about stuff that matters - so we quickly switched back.

Get the judgment and frequently the court personnel will instruct you on how you can collect.
