This can be a tricky area so I suggest you consult with your tax adviser who could better assist with whether this applies in your specific situation. 

Since you're new, you should find a good attorney who's experienced with this and have them advise you IMO.  

I'm not an attorney, so I don't have any legal advise per se, but it sounds like you've done what you can to get them to vacate.
