They can switch to transaction broker but that means not offering advice or coaching either side, and they've already coached the seller as their fiduciary up to that point thus far, so it opens them up to a lot of liability... hard to serve 2 masters when those 2 masters have opposing interests.

My concern with selling is 30 days is a pretty short timeline to try to sell (I'd guess you have an extra 30-60 days before everything goes through)....If they deed back to the seller, I'm sure there would be a way to convert it to like a master lease with an option to purchase?

If the listing agent has to do all the work for both the buyer and the seller, and take on that extra liability of getting sued because it’s impossible to serve 2 masters equally when those two masters have opposing interests, then they should get paid twice as much.

Unless you're talking about taking over title in 2025 under some sort of master lease agreement, she will be hit with capital gains tax regardless of what seller finance terms you come up with.
