If you calculated the math per the terms of the note, that sounds like something you can defend and explain.All that said, $5,000 is cheap money on a $7.5MM property.

That easement would be more difficult to defend in court but despite that fact, having so many years of continuous use would constitute an implied or prescriptive easement.

However I can see all tenants arguing 30 calendar days, to benefit themselves and it would be hard to defend.

The reason is because there’s a law in California that prohibits County Assessor’s Offices from posting the home address of any elected or appointed officials (i.e. members of the legislature, City Attorneys, District Attorneys, Public Defenders, Police Chiefs and Sheriffs, federal judges, etc) on the internet.

That being said I probably wouldn’t defend myself in a murder trial but I would in a eviction hearing because I’m not afraid to lose and know what to expect . 

My problem is everytime I do, I constantly have to defend myself and the reasons I am interested in real estate investing.

I am just looking to get tips or ideas, that when the time comes, I can be prepared to defend my efforts fairly. 

This story doesn't help me, as much as make me nervous that I may already be talking to this guy about a deal and have no idea.If he wants, he can defend himself here and tell his side, but wither way, we can make our decisions with full information. 

Or why not pass a criminal defense law that says the prosecution cannot spend more money than the defense (equal funding to both sides) - so that less people are compelled against their will to take a plea deal that includes a conviction just because they're scared to get a worse outcome if they go to trial with a public defender with 1/10th the budget to put on a defense.

And as a lawyer at a luncheon quipped, you really don't want a new nickname, that being "defendant".I would look into ALL the zoning, licensing, insurance issues, etc. for running a day care in your rental.
