I have tenants who just moved into my condo and are requesting compensation for: (1) repainting (I had to repaint a wall in a different color than they originally saw when I took down my speakers); (2) loud bathroom fans in each bathroom; (3) Ceiling fans that are outdated but functional; (4) wall wiring so that their t.v. does not reveal the wires; (5) fridge filter which admittedly was old and they noted that my flooring has a soft spot but did not request replacement (yet!).  

The government taking a broad brush stroke to interpret vague language the way they want to doesn't cut it.

You seem to allow you to be bit flexible without making you too soft. 

You could add a soft brown as an accent color and the fence would look like it fit right in instead of looking a bit faded.  

Your attorney will know what language to put in there.And finally, brush up on landlord tenant laws in your area.

  A tenant with a sloppy paint brush can really make a mess and really damage a property.  

Not to go too far afield from the original question but this town is different from any other towns with trains because we are  our own little slice or paradise...when you throw your line in the ocean you pull out a plump tasty fish and when you scatter some seeds you grow our own special datil peppers to make a tasty hot datil sauce to brush on your tasty fish...and then throw some oysters and clams on the beach fire grill...we have oceans where you can surf and skim board and Intracoastal where you can Kayak and windsurf  and marshes where you can see pretty pink spoonbills and historic streets and buildings where you can dress like a pirate and drink rum and go argggg....when you can live here NO ONE I repeat NO ONE wants to live by the tracks...so to the original poster I say I would NOT buy anything on the railroad tracks ! 

At this point that is irrelevant, you don't need to change your brand new brushed nickel door hardware and painting a brand new, PT deck is not going to bring a buyer either.
