I am looking for 100,000$ for my portion of the investment. this is my next step in real estate (raising capital) because i have used all my money in my current portfolio.I have an investor that wants to invest and I have have briefly explained the opportunity over the phone.I have also spoke with a lawyer about how to do this.

If audited, you have to prove that the payment did happen. 1099s is a separate issue which the IRS might raise in a audit but usually does not.
