If they used a loan for a primary residence, there may be some ability to enforce something but that really doesn't impact your decision. d) There is no effect on capital gains since they didn't use it as their primary residence for 2 years.

I can tell you that a BRAND NEW duplex that is being built is being bought by majority of FHA loans; however I still think a investor can make a return since this market will cause a slow down in buying soon basing this off if interest rates go up!

If you're going to live in it you could look at Fannie Mae propeerties that will get approved for an FHA loan with 3% down.
