As I understand it, that is a tenant's responsibility, to leave the unit in the condition that they took possession of it in, minus normal wear and tear.The cost of these items were given in advance and signed by tenant as part of the lease agreement.

I would wait until you have possession of the property before signing the lease.

As they say, "possession is 9/10th of the law."  

Did a little detective work and I think what happened was he left early without legally returning possession, so they filed eviction and detainer, plus the difference between his security and the 2 months rent loss.I just offered them the unit with 2 conditions, last month as Mark helpfully suggested (didn't know that was legal) and that they use an automatic ACH payment or a service like Cozy.I was planning on asking them to sign at least a 15 month so it's up in the spring next time.

You don't have possession of the property unless you file a dispossession and get legal possession of the property!  

And that rents are current with no balances due at possession. 

I am asking for possession of the premises, April rent, late fee, and my court costs.

This rental amount is due for each month that Tenant remains in possession of the Leased Unit, as a holdover tenant.

We no longer have to sue for possession, but I am going after her for damages.
