The unique setting is quite the bonus to keep us above 95% occupancy every month.

The reason the premium went up after that is because the occupancy was lower since we were remodeling.

My thought was send them a message saying I see we have so and so listed as an occupant, we'll need to run a background check and get them added to the lease.

All current owners are allowed to maintain their rentals and a current owner occupant can convert to a rental.

I think you need a better attorney that knows how to handle illegal occupants quickly and firmly. 

You need to get an attorney who serves notice to vacate to the current occupant.
