These houses were built by a company and are all on its own private street and pretty much identical to each other.  

It would be hard to prove that you are treating the asset and the LLC as a separate entity, thus benefit from its separate identity.

Some people make good landlords, some don't, identity that.

If the old Landlord keeps it, I would consider that theft and I think a court of law would agree.If it's not too late, have the tenant put a "stop payment" on the check before it's cashed.If it's too late, notify the old Landlord - in writing - that the money rightfully belongs to you for payment of rent and demand return within XX days or you will file a claim in court.

It will not keep their identity secret.  

I understand that the property will still be covered by my personal liabilty insurance, but I would like to move the other business aspects into a separate business identity.
