You should, however, include a clause in your purchase agreement stating that keeping the earnest money is the seller's sole remedy in the event you don't follow through, and that they cannot sue you for specific performance.

The two most used out clauses are "subject to inspection" and "subject to partners approval"You also need to make sure that the earnest money is the sole remedy against you incase you cannot find a buyer and get the house closed.

If not, and you only have a grand or two on the line as earnest money, and the contract states that the sellers only remedy if you don't perform (i.e., no "specific performance" clause), you might really think about letting that go and walking away.
