@James Wierzba this is not a straight-forward issue.In a PERFECT world the tenant would have brought up the water issue. 

It could be brought in from the other side of the property but the cost was a whole lot more .

I had brought it up to my lender using the term "delayed financing" and he knows this would not be "refinancing" an existing loan, but he said this is basically a "cash out refinance."

Handing over your keys and responsibility of a home to someone who brought nothing to the table is super risky and if it falls through, it will be your responsibility again, and you won't have anything to cover yourself with.
