Add in the fact that the title agent may have an interest which could be adverse to the Insured's would render the giving of the advice a conflict of interest and would probably be prohibited by the local Bar's rules of ethics

@Mehul RupaniYou might look into whether the missed depreciation would be treated as an error and rectifying by filing an amended return.I believe a 3115 is only filed if a method was adopted/established (by consistent treatment on at least 2 consecutive tax returns) and you will be changing the method from an impermissible to permissible method.Wouldn’t recommend DIY in this area, it’s pretty technical and the full facts should be reviewed by a tax professional or offer proper advice before taking any action.Hope it helps

They came and did a 3 week intensive treatment and it was about $500 for traps and bait boxes around the whole 8 unit property, traps and bait boxes in that one unit and in its ceiling where they were hearing the mice running and in the basement adjoining their unit.

Understood - so if I hold for a year as a rental would open the option for 1031 (and also to sell as capital gain versus ordinary income).If you use this property as a rental, then yes, it changes its character to a rental property, and it opens the door to capital gains treatment and to 1031 exchanges.
