I thought I was getting an amazing deal but what I'm ending up with is; essentially locked into closing on house where everyone expected the current tenant to leave cooperatively however, he is now planning to stay indefinitely without paying rent until getting evicted.

Tenant protection issues - We’re in CA and introduction of limits on rent increases so want to be sure that we have the lease structured so the tenant reverts to a market rate rent at the end of the 3 year period or moves out if unwilling to pay that rate.I’m struggling with the 3 year lease being long, I don’t think I could enter an indefinite (til death) lease.Another thought what if one spouse dies and the survivor remarries a younger person?

I also do invest in ground up build to rent MF, but those are also unique deals where you get your capital back after about 5 years but still hold equity going forward indefinitely so that you get infinite returns from the cash flows and the equity continues to grow over time.

Once the 1031 exchange is completed (again assuming 1031 compliance), I can continue to rent the property indefinitely or at any point after 2 years of rental, use it as a primary residence and thereafter living in the property for at least two years qualify to use the Section 121 Exclusion to eliminate capital gains entirely (gains estimated to be about $70 K, well under the $250,000 single filing limit).

A Lot of agents 1) don’t really know all the intricacies/procedures/rules/strategies to do a short sale and 2) don’t want to do all the extra work involved in one, for no extra fees.Attorneys are not great for negotiating/processing shorts sales…they often slow the process down are not needed.If it comes to that point, have a talk with your agent, and their broker, about switching to an agent with short sale experience.You would need to show a financial hardship though….as in you can Not afford to pay the negative cash flow indefinitely
