You did not note the 401(k) as already being Roth status, so I am making that assumption.There would be a 5 year seasoning period on the originally rolled over basis, after which you would have the ability to draw down up to that amount tax free.Any earnings generated from that originally converted basis will be taxed as regular income and subject to a 10% penalty if withdrawn prior to age 59 1/2, unless you meet one of the exceptions such as financial hardship, disability, etc.
