This is a recent decision where a title insurer denied coverage to an insured owner who had been named in a suit to rescind the deed into the insured. 

I am wondering if this is just the wrong time of the year.

Are the properties close to in the distance to each other? 

A person could be 1 week out of prison for murder and no, your not in the clear to discriminate against them as a potential buyer for an open market home sale.There is a lot of history with various discrimination in access to housing to various persons of assorted minority classes, not just on race but a whole assortment and in this day n age there is no shortage of attorneys and advocacy groups happy to sue.

Unfortunately, the only way to go about this is the get the property rezoned and convince the zoning board of your proposed use. 

They will also dictate the terms of the loan, how it's filed, qualifications, etc.However, if you mean PML as in your friends/family that have NO experience in real estate and just have money sitting around...then I would certainly to counsel you to lean on some type of mentor or other experienced investor in Houston on what to do.
