Some sort of cash for keys agreement is going to be your best option, you can't just throw people out when they have a valid lease, are paying the rent, and aren't violating terms of the lease.  

I checked the warranty book that the builder provided me and it states roof warranty is only for one year.

Mike Hartzog is there a step to validate these payments?

He just left me a voicemail, stating that he is going to go to the property to get his mail....he has no valid lease there anymore, his lease that was in effect has even expired.
