There are lenders who will do the loan if no health or safety issues even with litigation (depending on the details). 

call county health department and verify that this is the rule.I have never heard of  3year inspections required by a county health department does not mean its not true but I would want to verify that.

Another idea perhaps more leverage than anything would be the threat of a forced sale where OP would collect first every dollar put into for the property over the years before the pot is split.

Probably good to have one or two of these started early rather than later since the the premium will increase as you age due to health/age.

In my opinion with a system such as this, once the tenant is late, there  is no further motivation for a tenant to pay other than threat of eviction.
