An estate attorney should be addressing this, it depnds on the trust and depending on the registration of the LLC, the trust may be named as a member opening the trail to the trust, so the registration requirement may dictate the plan.I have trusts and LLCs, but they are not formed because I'm as paranoid as most seem to be here.

Just wanted to post this quote from an article I read, although I think banks are still ignoring it (as common sense does dictate main goal should be to make sure you are making a good loan that won't default, not that you are not penalized for making a bad loan), regarding it not affecting their default numbers: Banks didn't want their Compare Ratios to rise. The FHA has acknowledged this issue and, similar to how HARP II waives reps and warrants on HARP refinances, the FHA will now exclude FHA Streamline Refinances from its Compare Ratio calculation.

In fact, in Georgia, agents who are not members of NAR are NOT ALLOWED to use NAR forms unless they pay a separate fee for those forms -- and many agents in Georgia don't pay those fees and don't use those forms.I can't speak for other states, but the Georgia Real Estate Commission does not dictate what contracts agents can and can't use; therefore, you can use any valid legal document your broker allows you to use, and if you're a broker yourself, you can use any valid legal document you choose.I'm not saying it's wise to use your own contracts...I'm just saying it's not illegal.
