I live in Georgia I am not sure this issue is covered in the hand book I figured I would float it hereI had a unit for rent in the first week of july say july 2, man came and said he wanted it immediately he had a good job drove a nice car was well put together. he had income verification statements He made a partial deposit of 300 no paper work just a receipt he was supposed to move in on the 15th of july on the 15th he came with another 200 which was the rest of the deposit but he said he didnt want to move in until augustthis didnt make me happy and as he stated there was nothing in writing forcing him to a july 15th move in datenow he states he doesent want to move in at all and wants his deposit back.I basically held this apartment for 30 days and now he does not want it,there was no written agreement but the rental application does stateThe following deposits are required: - security deposit of the first month's rent of 550.00 payable upon move inThe deposit will be returned to the Applicant if the Premises are not rented to the Applicant.

After first-last-security deposit is paid, he and his family are moving in, my new best buddy has his house rented, and I'm making $200 a month until they qualify for their loan in about a year or so, at which point I get the difference between what I've negotiated my seller down to, and what my buyers have already agreed to pay.I go out to my car to get my paper-work, and find that I have several copies of contracts for cash-offers, but none for lease-options....are you @#$%ing kidding me?

All I know is that Guidant (and the attorney they hired for me) told me everything I was doing was fine, and they'd occasionally send me some documents that they said were very important and that I must keep them with my plan documents to avoid running afoul of the IRS.I didn't feel like I had enough information or control to be making an informed decision about whether what I was doing was legal or not, so I erred on the side of caution.Ultimately, the IRS officially determined that everything Guidant and I did was legal.

In addition, make sure to have an assignment page that will cover you that will have options for you to accept a non-refundable down payment and having a clause for reimbursing you as an assignor for any costs you may incur while placing the property under contract..i.e earnest money or option/due diligence fees.So, if you contract a property with a seller you'll have them sign your contract, an investor buyer sign the assignment page, and place a non-refundable down payment with you to secure the deal.It would be a good idea to create a relationship with a title company or closing attorney that has investor experience to hear what advice they have for you.
