To retain it otherwise would be illegal unless the deposit was initially intended as their last months rent.You are operating a business, your lease is a legal binding contract, if you do not intend to inforce your lease there is no point in having one.

Are you just making a list and contacting them for future reference, or are you talking about retainers and contracts for services?
