Even then, it would be easy to prove the validity of the payment with the lease agreement.

It's a relatively new house, but from everything I've heard electricity bills are much more experience than gas heat (at least in the Houston area).  

Once you know this depending on your relationship with the neighbor I would make them aware you know the statutes including Fair housing and their complaints (acknowledge them if they are valid).
