If you do not have this room, then you better have your own cash to close the A to B or more likely, you didn't negotiate a good enough deal to begin with as Justin pointed out in one of his responses.

Texas law does not clearly define abandonment but those are some of the criteria along with a signed agreement would have been good enough for me.

You have to have a HELOC high enough to buy and rehab a property AND be able to find such a property in a neighborhood that will have a good enough appraisal after rehab and that will draw enough rent to cash flow.in your opinion which is better?

Run the deal numbers with paying the full realtors commission on top of the deal to see if it still works.If the deal was still good enough after due diligence, title search, and paying the realtor commission etc, then keep negotiating with the seller but try to split the realtor commission with the seller or plan to pay it yourself.
