You could write the initial contract to state earnest money is not refundable but it would be difficult to find a buyer willing to accept these terms as they are not standard for the market here.I offered to extend the contract only if the buyer makes an additional non-refundable earnest money deposit and converts their original earnest money deposit to be non-refundable as well.
