I'm not sure, but I think mtg surpluses here are just like tax deed suplus overages here....to collect the overage you must have an assignment from the owner AND a disclosure signed by the owner stating that they can collect the overage themselves, and where and how.

Not that your lender is likely to lend for more than the appraisal says it is worth anyways, assuming it's a vanilla mortgage.I used to throw the 3 day waiver in with initial disclosures on every single transaction, until the compliance people told me I was being naughty.
