The tenant is now citing 1941.1 and implying that I need to pay for monthly spray.Under California Civil Code §1941.1, landlords are required to maintain rental properties in a habitable condition, which includes ensuring the premises are free of pests that compromise livability.

Don’t do your LLC in California.  

If you are in a high fire zone, the California Fair Plan is likely your best bet.

Another consideration is that if you do a 1031 exchange back out of CA the state is a "claw-back" state so CA will try to get their capital gains eventually.
