John whether you realize it or not the delivery of what you are saying on the phone and pitch is just as important as the words themselves.You need to practice tone on the phone and video tape yourself giving a presentation in the house.I did this work years ago and now it is natural for me to talk on the phone and meet people in person.It flows now and is not forced.With anything in the beginning you will be really rough at it.Listen for key words on the phone for high motivation.Job loss,divorce,death,sick family,facing foreclosure,having babies and need more space,selling to free up capital,job transfer,getting married,executor of an estate,out of state investor etc.etc.Low motivation:1.Just seeing what the market will bear2.Waiting for my price 3.Need XXX to pay my bills4.Need larger house if I can get XX for thisand on and onEventually they might have life circumstances that change them to motivated but today they are not.Stay in contact because you never know.

You need a "MODIFICATION OF NOTE AND DEED OF TRUST"You need to describe the note,and deed of trust, made on such n such date, by so and so, payable to so n so, recorded in book xxx at page xxxxx in whatever county, State.You need to say that this modification is made for the extension of the original term of the obligation to such n such date and that all other terms, conditions and covenants of said note and deed of trust, unless specifically herein modified, shall remain in full force and effect.If you change payments or any other terms, specifiy the change.The modification can usually be done in one page and should be filed for record.

Worst case scenario would be that you documented an illegal act which will break most leases and then both of them are notified that they have broken their lease and must leave by XXX time.Your lease contract wording will need to be looked at by an attorney very closely at this point to see what violations actually break the lease.THEN GET RID OF THEM.Mike has noted cases where this did not work for him so the attorney route will probably be needed to help you legally do things.

In this case, the buyer IS the trustee.Here's the scenario:In October, Buyer B writes an offer to Seller A.In February, Buyer B writes a new offer to Seller A after the bank's counteroffer.Right now, Buyer B is waiting for an approval letter from the bank.Title company is telling me that to use a land trust which assigns Buyer B as the trustee or the 123 Street Family Trust.That way, lender C can start working on the B-C side because they see B on title as trustee.Beneficial interest currently remains with seller A, but will be transferred to XXX Corporation at some point.So how is using a land trust going to affect the A-B transaction?

I would ask Seller to1) Replace/Repair desired items (list)oryou will inherit and deal with these issues and now will ask for $$$2) Seller will credit Buyer at closing $XXX amount for home repairs(if using a lendor, ask them the max. amount or % that they will allow a Seller to credit a Buyer as this may affect the loan)I would also attach a copy of the Home Inspection Report for the Seller to review so they know the request is legit.Best of Luck!
