I would expect that the requirement is that you hand out a demand letter for payment in person (we call it a 5 day notice in my market).The first thing I would do is consult an eviction attorney.

Hi @James Black, I'll forego the obvious clarifications about consulting a tax advisor (which I am not) and jump right to it: unless you have lived in the property as your primary residence for 2 of the past 5 years you will be looking at capital gains.
