How is intent judged aside from hard evidence?

Not something anyone I know would do unless the equity was amazing and there was strong evidence of ability to repay.

@Natalie KolodijNot 100% true, strictly speaking. per section 1250(b)(3):... if the taxpayer can establish by adequate records or other sufficient evidence that the amount allowed as a deduction for any period was less than the amount allowable, the amount taken into account for such period shall be the amount allowed...HOWEVER, as I mentioned above, (per section 1016(a)(2)) you adjust the basis by the allowable depreciation - which means you would have to pay capital gains on the value of the allowable depreciation without ever having taken a deduction for the depreciation.Taxes are easy.  :-0

Usually, it takes anywhere from 48 hours to 10 days to draw documents & fund the deal, and the HML usually can not draw docs or fund they we have all the required details from the borrower such as verification of down payment (if required), copies of company papers if purchasing in a company name, as well as a title commitment, closing protection letter, wiring instructions, and evidence of vacant dwelling insurance.

I agre with @John Hickey in that some of the posts here on BP are bad advice and that becomes pretty evident to experienced investors.
